Amazon won a court order temporarily blocking enforcement of New York’s statute attempting to claim jurisdiction over private-sector union disputes, which the retailer argues is preempted by federal labor law.
The state law likely runs afoul of the National Labor Relations Act and should be enjoined while the legal challenge against it proceeds, the US District Court for the Eastern District of New York found.
Backers of the New York law—similar to a new California law that’s also facing a suit—said it was necessary to protect workers’ labor rights while the National Labor Relations Board was impaired by a lack of a quorum.
Amazon.com Services sued to challenge the New York law, shortly after the Teamsters-affiliated Amazon Labor Union filed an unfair labor practice charge against the company with the New York Public Employment Relations Board.
In separate federal lawsuits, the NLRB also is challenging the New York and California laws.
The case is Amazon.com Services LLC v. NY State Public Employment Relations Bd., E.D.N.Y., No. 1:25-cv-05311, 11/26/25.
