A D.C. federal district court judge denied an agricultural trade group’s attempt to block a Biden administration overhaul of seasonal guestworker visa regulations.
The Department of Labor last year issued a rule governing prevailing wages and employment conditions for guestworkers on H-2A agricultural visas. It also addressed issues including housing and transportation as well as requirements for recruitment of US workers. The National Council of Agricultural Employers sued, arguing that DOL unlawfully pulled the 2021 rule without notice and comment under the Administrative Procedure Act and unlawfully issued the regulations last year without following those procedures.
