H-2A Visa Program Updated Under New Labor Department Rule (1)

The Department of Labor released updated regulations on the prevailing wages and minimum standards for employment conditions for workers on H-2A agricultural guestworker visas.

The regulations released Thursday (RIN 1205-AB89), set to be published in the Oct. 12 Federal Register, originally were released as a draft rule by the Trump administration in 2019. They also seek to streamline the application process under the temporary visa program.

The final rule keeps much of that proposed 2019 rule, but incorporates changes based on a subsequent public comment period. DOL dropped, for example, language from the proposed rule that would have ...
