A former Insomnia Cookies LLC delivery driver will pursue her wage-and-hour claims in Indiana after the company proposed transferring the case from New York to the state where the alleged violations occurred.
The ex-employee told the US District Court for the Southern District of New York that she didn’t oppose moving the Fair Labor Standards Act case to the Northern District of Indiana, where she worked for the cookie delivery chain. “Convenience and the interests of justice” support transferring the would-be collective action, Judge Jennifer H. Rearden said Monday.
