DOL Appeals Ruling Blocking $15 Federal Contractor Minimum Wage

The US Department of Labor is asking a federal appeals court to reverse a ruling blocking the agency from enforcing a $15 minimum wage for federal contractors in three Republican-led states.

Judge Drew B. Tipton of the US District Court for the Southern District of Texas ruled in September that President Joe Biden didn’t have the authority to raise the minimum wage for federal contractors to $15 per hour via an April 2021 executive order.

The ruling also barred the DOL from enforcing its rulemaking that implemented the $15 contractor wage order, but the decision only applied in the three states that sued—Texas, Louisiana, and Mississippi.

Attorneys for the government appealed the ruling to the US Court of Appeals for the Fifth Circuit on Nov. 22.

The case is State of Texas et al v. Biden et al, S.D. Tex., No. 6:22-cv00004, appeal filed 11/22/23.
