Transdev Services Inc. bus drivers alleging California wage violations in federal court must justify keeping their class status after failing to put state suits on pause.
The lead federal plaintiff urged the US District Court for the Southern District of California to stay parallel proceedings in California’s state courts after last month winning permission to proceed as a class. But she secured class certification partly by saying there wasn’t any indication potential members had filed related litigation, so the earlier cases “undermine” that status and “call into question Plaintiff Counsel’s candor to the tribunal,” the Monday order said.
