Atlantic City’s Borgata Casino Hotel & Spa must stand trial on claims by five female cocktail servers that its “Borgata Babes” appearance policy amounted to sexual harassment, a state appeals court ruled.
Jacqueline Schiavo and the four other women were correct that a lower court mistakenly re-weighed the evidence following an earlier appeal in the case, the New Jersey Appellate Division said.
