Bimbo Bakeries Hit With New Overtime, Benefits Suit by Drivers

Bimbo Bakeries USA Inc. misclassified drivers as independent contractors rather than employees, depriving them of overtime pay and benefits, a suit filed Wednesday in federal court in Vermont alleges.

The drivers routinely work more than 40 hours per week, but aren’t paid time-and-a-half overtime for the additional hours, the plaintiffs say.

The company also unlawfully requires them to bear its business expenses by deducting from their paychecks for use of the company’s electronic equipment, lost or stolen product, and other expenses, the complaint alleges.
