Out-of-State Drivers Dropped from Bimbo Bakeries OT Lawsuit

Twenty-two delivery drivers who wanted to join a worker misclassification lawsuit against Bimbo Bakeries USA Inc. must be dismissed from the New Hampshire-based collective action because they’re not residents of the state, a federal judge said Tuesday.

There isn’t enough of a relationship between the non-resident drivers’ wage claims and the state of New Hampshire to justify jurisdiction, Judge Steven J. McAuliffe said for the U.S. District Court for the District of New Hampshire.
