The U.S Department of Labor’s federal contractor watchdog has proposed rolling back part of a Trump-era rule that required the agency to meet a specific standard for bringing bias claims.
The November 2020 rule codified how the DOL’s Office of Federal Contract Compliance Programs would issue two formal notices after it uncovers potential bias in audits and required the agency to provide more details on the statistical evidence before bringing a claim. In a notice of proposed rulemaking announced Monday, the Office said that the contractor-friendly evidentiary standard limits the agency’s ability to investigate and remedy bias allegations.
