Anthem Fails to Ax Nurses’ Overtime Claims, Collective Status

Anthem Cos. lost its bid to end a suit alleging it misclassified nurses who review insurance claims as exempt from overtime and failed to decertify their wage-and-hour collective.

The nurses don’t fall under the Fair Labor Standards Act’s administrative or learned professional overtime exemptions, the US District Court for the District of Minnesota said, granting partial summary judgment in their favor, denying Anthem’s bid for a pre-trial win.
