Anthem Nurses Win Early Collective Status in FLSA Overtime Suit

A group of nurses who reviewed insurance requests for Anthem Cos. Inc. may proceed as a certified Fair Labor Standards Act collective on claims that they were misclassified as exempt from overtime pay, a federal judge in Minnesota ruled.

Although the nurses had different job titles, the evidence shows they performed the same primary job duty and that Anthem uniformly classified them as exempt, Judge John F. Docherty of the U.S. District Court for the District of Minnesota said.
