Amazon Virus Screening Pay Case Needs Nevada High Court Input

An Amazon.com Inc. subsidiary’s dispute with workers who say it owes them pay under Nevada law for time spent on Covid-19 health screenings is headed to the state’s highest court.

Amazon.com Services LLC faces a proposed class action alleging it failed to compensate workers for time spent undergoing pre-shift health screenings at the start of the coronavirus pandemic. Whether state law incorporates the federal Portal-to-Portal Act is “at least partially dispositive,” the US District Court for the District of Nevada said in an order docketed Tuesday, certifying that question to the Nevada Supreme Court.
