Amazon Denied Second Chance to Block NLRB Case at Fifth Circuit

Amazon.com Inc. couldn’t convince a full federal appeals court to reconsider an earlier decision against freezing a National Labor Relations Board case involving a landmark union election win at one of the company’s massive warehouses.

The US Court of Appeals for the Fifth Circuit rejected Amazon’s request for en banc review of a three-judge panel’s divided ruling, which found that the company prematurely sought appeals court intervention to challenge a lower court’s “constructive denial” of its preliminary injunction petition.
