Amazon.com Inc. failed to convince a federal appeals court to stop the National Labor Relations Board from acting on unfair labor practice allegations against the company while it proceeds with its constitutional challenge to the agency.

Amazon prematurely sought appeals court intervention by wrongly equating a district court not ruling on a request for a preliminary injunction by the company’s eleventh-hour deadline as a “constructive denial” of its petition, the US Court of Appeals for the Fifth Circuit held in a divided ruling Tuesday.
