Airgas US LLC can’t escape a lawsuit alleging the company illegally fired a worker with cancer because a drug screening company said he tested positive for cannabis, despite the test actually detecting a substance from the legal hemp product he was taking to treat his pain, a federal appeals court ruled.
The US Court of Appeals for the Sixth Circuit on Wednesday reversed a lower court decision throwing out Murray Fisher’s claim under Ohio disability law that Airgas fired him because of his cancer. Fisher died last summer.
