Airgas USA LLC prevailed in a disability discrimination suit brought by a worker who disputed his firing over a positive marijuana test, saying he used a legal hemp product to treat his cancer-related pain.
Murray Fisher failed to demonstrate that his hemp use was necessary to treat a limitation caused by his cancer, and Ohio doesn’t have a clear public policy prohibiting employers from terminating employees for using a legal, over the counter product to control pain, the US District Court for the Northern District of Ohio ruled Thursday.
