A lawsuit against office supplies wholesaler Essendant Inc. over unwanted faxes has been dismissed with prejudice on agreement of the parties, according to a joint stipulation filed in the U.S. District Court for the Northern District of Illinois.
The agreement between Essendant and plaintiff Craftwood Lumber Company to dismiss the case comes about four months after Judge Thomas M. Durkin denied Craftwood’s motion for class certification for the second time for lack of commonality.
