Office supplies wholesaler Essendant Inc. doesn’t have to defend class allegations in a Telephone Consumer Protection Act lawsuit claiming it sent, over a four-year period, around 1.5 million faxes to nearly 24,000 unique numbers, the U.S. District Court for the Northern District of Illinois decided Thursday.
Judge Thomas M. Durkin denied plaintiff Craftwood Lumber Company’s motion for class certification, concluding, for a second time, that common questions didn’t predominate and that individual litigation would be superior to any class resolution of its TCPA claims.
