Bayer, Consumers Resolve ‘Mineral-Based’ Sunscreen False Ad Suit

Bayer HealthCare LLC and Beiersdorf Inc. have reached a settlement in principle to resolve a proposed class suit alleging certain “mineral-based” Coppertone sunscreens are deceptively marketed, filings in a California federal court show.

Steven Prescott and Mike Xavier alleged consumers could construe the words to mean the main active components are mineral ingredients, but the products contain a roughly equal proportion of chemical active ingredients.

The plaintiffs stated a viable deception claim, and federal law doesn’t preempt their suit, the U.S. District Court for the Northern District of California said last year.
