Victoria’s Secret Worker Lacks Bias Claim Under Philadelphia Law

Victoria’s Secret Stores LLC doesn’t have to face a sales associate’s sexual harassment and retaliation claims under Philadelphia law because she failed to exhaust her pre-suit remedies, a federal judge ruled.

The decision highlights the unsettled question of whether workers have to file a charge directly with the Philadelphia Commission on Human Relations to sue for discrimination under Philadelphia Fair Practices Ordinance. They must, US District Court for the Eastern District of Pennsylvania Judge Mark A. Kearney said, reaffirming his view from a prior case “in light of recent, thoughtful consideration of the issue” by other judges.
