Texas Can Enforce Online Age-Check Law While Fighting Injunction

Texas may continue to enforce its online-porn age-verification law while it appeals a lower court’s preliminary injunction blocking the law, the Fifth Circuit ruled Tuesday.

A district court issued the injunction and voiced concerns that the law wasn’t narrowly tailored to its purpose of preventing harm to minors, as required to pass First Amendment muster. The Free Speech Coalition, a group representing the adult-entertainment industry, challenged the measure requiring pornography websites to check that their users are adults and warn visitors of potential harms.
