Diablo Canyon Funding Suit Lacks Standing, Energy Agency Says

The Energy Department is asking a federal court to dismiss a challenge against the agency’s decision to award more than $1 billion to the Diablo Canyon nuclear power plant in California.

Nonprofit Friends of the Earth doesn’t have standing for its suit because its alleged injuries aren’t redressable, the agency told the US District Court for the Central District of California on June 14.

The environmental group challenged the federal funding approval in April, saying DOE used an environmental analysis more than 50-year old—along with other “outdated” documents—instead of conducting a new National Environmental Policy Act review.
