A federal Michigan court should certify a class suing several counties for the surplus proceeds of tax-foreclosed homes, the plaintiffs said.
The US Court of Appeals for the Sixth Circuit ruled that Thomas Fox, who brought his action against 27 Michigan counties, lacks standing to sue the 26 counties which the court said didn’t injure him. Fox has now presented other putative class members, each of whom has been injured by each defendant county, he told the US District Court for the Eastern District of Michigan on Oct. 4.
