Michigan Counties Get Class Decertified in Property Seizure Suit

A class action challenging Michigan counties’ power to seize and sell tax debtors’ property without returning any surplus was decertified by the Sixth Circuit on Friday.

The US Court of Appeals for the Sixth Circuit ruled that Thomas Fox, who brought his action against 27 Michigan counties, lacks standing to sue the 26 counties which the court said didn’t injure him.

Fox filed his complaint after Gratiot County took and sold his land for $25,000 after he racked up more than $3,000 in unpaid taxes. Gratiot County didn’t return any of the surplus to the plaintiff after the sale.
