BakerHostetler Beats Malpractice Claims but RICO Case Remains

BakerHostetler defeated a majority of a lawsuit accusing the firm of aiding insurance fraud, but it still has to face Racketeer Influenced and Corrupt Organizations Act claims.

The lawsuit, filed by Alliance Health’s liquidating trustee in 2022, alleged BakerHostetler committed legal malpractice, among other claims, when the firm assisted the pharmaceutical company in a scheme that resulted in more than $100 million in damages. BakerHostetler moved to dismiss the suit last year.

Most claims brought by the trustee, on behalf of the trust and Alliance’s largest creditors, lacked standing or were time-barred, but the RICO claims were sufficient to continue, ...
