Tesla Claims Revived in Louisiana Regulator Antitrust Appeal

Tesla Inc. netted a partial win in a lawsuit accusing Louisiana regulators and car dealerships of conspiring to restrict its business after an appeals court revived some claims that were previously dismissed.

The electric carmaker’s claim that its due process rights were violated has merit, the US Court of Appeals for the Fifth Circuit held in a split decision Monday authored by Judge Jerry E. Smith. The appeals panel reversed a lower court’s dismissal of the claim, finding Tesla needed to show only that the defendants intended to exclude the company from the state to keep the allegation alive.
