LegitScript Loses Antitrust Appeal in Drug Import Legality Case

Oregon-based pharmacy compliance firm LegitScript LLC lost its bid to end an antitrust case after the Ninth Circuit upheld a district court decision that the plaintiff’s allegedly illegal conduct doesn’t bar antitrust standing.

The US Court of Appeals for the Ninth Circuit on Friday affirmed the lower court’s decision to deny summary judgment to LegitScript, holding that “an injury to the fruits of a plaintiff’s illegal conduct can confer antitrust standing.”
