Walmart Huffing Spray Suit Over Girl Scout Deaths Greenlighted

Walmart Inc. failed to shake off a suit by relatives of two Girl Scouts and a chaperone killed by a driver high on Ultra Duster purchased from the retail giant, after the Northern District of California rejected the argument that there are required parties who can’t be joined.

Walmart argued that additional plaintiffs pursuing a state court action in Wisconsin, where the accident took place, arising out of the same fatal accident are required, because proceeding without them “will expose the existing defendants to a substantial risk of incurring double or inconsistent obligations.”
