A security guard for Soldier Field, home of the Chicago Bears, may proceed with claims of excessive force and unreasonable seizure against an off-duty police officer who was working security at a game in street clothes, a federal trial court ruled Monday.
Brian Beebe, a Deputy Sheriff for DuPage County, failed to shake off Walter Carr’s claims under Section 1983 of the Civil Rights Act because it’s “plausible” that Beebe was acting under color of state law at the time, Judge Marvin E. Aspen of the US District Court for the Northern District of Illinois ruled.
