Philly Airport’s Pepsi Preference Survives Antitrust Appeal

The Third Circuit dismissed antitrust claims by airport food and beverage company Host International Inc. over its aversion to a requirement that only PepsiCo products be served in Philadelphia International Airport.

Host lacks standing to assert antitrust claims against the firm managing retail space at the airport over contractual terms that require beverage vendors to exclusively serve Pepsi products, the U.S. Court of Appeals for the Third Circuit ruled Wednesday, affirming a lower court decision.
