A whistleblower accusing a Mississippi pharmacy of defrauding federal healthcare programs by paying kickbacks to doctors is barred from recovering proceeds from separate criminal cases, a federal district court said.
The parties and the alleged activities in the False Claims Act suit pursued by the estate of Robyn Turner—who was a pharmacist with The Gardens Pharmacy LLC—and the criminal cases “are plainly not the same and the overlap, if any, is minimal,” Judge Halil Suleyman Ozerden of the US District Court for the Southern District of Mississippi said in a ruling Thursday.
