An Ohio man convicted of heading a a multi-million dollar pyramid scheme that sold prescription pain creams should serve a 5-year prison sentence and pay nearly $7 million in restitution, the US told a federal appeals court.

Kevin Clay challenged his health care fraud conviction, his sentence, and the restitution order, arguing the district court had given improper jury instructions and applied an excessive enhancement for his alleged leadership role in the fraud.
