OmniView Capital Advisors CEO Loses Appeal of Fraud Convictions

A.J. Discala, the former chief executive officer of OmniView Capital Advisors LLC, lost his bid to undo convictions for securities and wire fraud, after the Second Circuit on Thursday rejected the “litany” of challenges he raised in the appeal.

Discala argued that the trial court should have suppressed evidence obtained pursuant to a wiretap, claiming that the wiretap application was critically flawed because it contained misrepresentations and omissions that suggested that the special agent who submitted it acted recklessly.
