Officers Win Excessive Force Appeal After High Court Ruling

A man who filed a federal lawsuit after FBI task force officers nearly beat him to death lost at the Sixth Circuit after the Supreme Court sent his case back to the appeals court.

The panel Wednesday upheld the district court’s dismissal of James King’s claims, declining to find that circuit precedent related to the Federal Tort Claims Act’s judgment bar has been overruled by intervening high-court precedent.

The bar says FTCA judgments block any action involving the same subject matter against the federal employee whose act gave rise to a claim.
