NY Cops Must Face False Evidence, Denial of Fair Trial Claim

Two New York police officers must defend a claim that they denied a suspect his right to a fair trial by fabricating evidence that he resisted arrest while they were executing a search warrant in his home, a federal trial court said.

The denial of the right to a fair trial requires a showing that the plaintiff was deprived of his liberty because officers fabricated evidence that was likely to influence a jury and gave it to prosecutors, the opinion by Judge Kiyo A. Matsumoto of the US District Court for the Eastern District of New York said Tuesday.
