Nikola’s Milton Argues N.Y. Is Wrong Place for His Criminal Case

Nikola Corp. founder Trevor Milton says New York is the wrong place for him to be prosecuted for securities fraud.

Milton urged a Manhattan federal judge in a filing late Tuesday to either dismiss the indictment against him or send the case to Utah, where he lives, or Arizona, where the company is based.

“The Constitution and federal venue statutes prohibit this prosecution in the Southern District of New York of a Utah man who formerly served as an executive of an Arizona-based company based on alleged misconduct that occurred outside this district,” Milton’s lawyers said in a court filing. ...
