Man Convicted for Child Porn Can Use Non-Internet Game Consoles

A man on lifetime supervision for possessing child pornography won the right to use videogame consoles as long as the devices can’t access the internet, under a ruling released Tuesday by the Fifth Circuit.

Christopher Abbate pleaded guilty in June 2010 in the Northern District of Texas and was sentenced to 10 years in prison followed by supervised release. He challenged two special conditions of his release. He argued that the prohibition on possession of pornographic material was vague and overbroad and that the ban on gaming consoles was overly restrictive.
