The US Supreme Court appeared unlikely to side with an alleged hitman in his bid for a new trial after prosecutors presented a confession from his co-defendant that he said incriminated him without naming him.
Justice Brett Kavanaugh expressed concern during arguments on Wednesday about adopting a rule limiting when prosecutors can introduce these types of redacted out-of-court confessions in a joint jury trial.
“We have an amicus from a lot of states, a real cross-section of states, saying this would be a huge problem,” Kavanaugh said.
