The due process clause’s limits on the admission into evidence of unreliable identifications weren’t violated when a government witness who had seen the perpetrator only a few times five years earlier, and who had been prepped for trial by prosecutors, was allowed to identify a defendant at trial as he sat as the only male at the counsel table, the U.S. Court of Appeals for the First Circuit held April 22 (United States v. Correa-Osorio, 2015 BL 114720, 1st Cir., 12-1300, 4/22/15).
