A constitutional challenge to New Mexico’s order banning firearms from Albuquerque parks and playgrounds was tossed Monday by the Tenth Circuit.
The claim against the park prohibition is moot because another court already enjoined it, the US Court of Appeals for the Tenth Circuit said. And the appeals court can’t provide relief from the playground ban because other regulations bar firearms from those locations, the court said.
The case is one of several around the country examining the legality of state firearm bans in locations deemed sensitive.
