A man convicted of a operating a “get-rich-quick” scam on Facebook lost his Tenth Circuit appeal challenging a below-guidelines sentence of 84 months’ imprisonment.
Shane Mack was found guilty of possessing counterfeit checks, unlawfully transporting a debit card, and of being a felon in possession of a firearm.
His sentencing range was 87 to 108 months, which reflected a four-level enhancement to the felon-in-possession charge. The enhancement was based on the court’s finding that Mack possessed the firearm “in connection with another felony offense.”
