Fluor Urges Supreme Court to Let Rejection of Bombing Suit Stand

Fluor Corp. told the US Supreme Court Monday that it should should pass on a US soldier’s attempt to reinstate his lawsuit alleging that the defense contractor didn’t do enough to prevent a suicide bomb attack in Afghanistan.

Winston Hencely contends that Fluor’s negligence allowed Ahmad Nayeb to detonate his explosive vest bomb on Nov. 12, 2016, at the US Army’s Bagram Airfield, resulting in six deaths and injuries to Hencely and 16 others.

The US Court of Appeals for the Fourth Circuit found that the combatant-activities exception to the Federal Tort Claims Act barred Hencely’s suit. The exception exists ...
