Florida Birth-Injury Claims Program Pays $51 Million in FCA Suit

Florida Birth-Related Neurological Injury Compensation Plan and its administrator agreed to pay $51 million to resolve alleged violations of the False Claims Act, according to the Department of Justice Monday.

The programs allegedly caused NICA participants to submit their healthcare claims to Medicaid rather than NICA in violation of Medicaid’s status as the payer of last resort, said the agency.

The case is (Arven v. The Florida Birth-Related Neurological Injury Compensation Association, S.D. Fla., No. 0:19-cv-61053, 11/14/22).
