Drug Marketer’s Convictions for Kickback Scheme Upheld on Appeal

A marketer for a Texas compounding pharmacy on Thursday failed to convince the Fifth Circuit to throw out his convictions and a $59.8 million restitution order for receiving illegal kickbacks in a scheme to get physicians to prescribe pricey medications.

Although the government didn’t show direct interactions between Quintan Cockerell and the doctor who prescribed the products, it still presented enough evidence that a reasonable jury could find him guilty of violating the Anti-Kickback Statute, Judge Carl E. Stewart of the US Court of Appeals for the Fifth Circuit wrote in the opinion.
