Credit Card Fraud Convictions Tossed On Speedy Trial Grounds

An Ohio man who pleaded guilty to a credit card fraud scheme won an appeal to vacate his conviction, after the Sixth Circuit said the government had twice violated his Speedy Trial Act rights.

The prosecution and the district court each failed to adequately justify their respective delays, the US Court of Appeals for the Sixth Circuit said Tuesday.

The US District Court for the Northern District of Ohio will decide on remand whether dismissal of the government’s indictment of Carlos Dashawn Brown for fraud and identity theft should be with or without prejudice.
