Family members of former DHB Industries Inc. executive David H. Brooks, convicted over his role in a $200 million financial fraud scheme at the body armor supplier, won’t recover the $17.7 million they contributed to his later revoked release on bail (United States v. Hatfield, 2015 BL 173481, E.D.N.Y., 2:06-cr-00550, 6/2/15).
The family members’ unexplained involvement in the defendant’s bail release violations did not support setting aside the bail forfeiture and releasing the cash collateral, Judge Joanna Seybert, of the U.S. District Court for the Eastern District of New York, concluded in denying their motion.
