Child Porn Evidence Barred Under Prior Invalid Warrant Ruling

A man who got child pornography claims dismissed after a trial court suppressed evidence obtained through a bad search won’t face reinstated claims despite a later Tenth Circuit ruling in federal prosecutors’ favor in a separate case about the same warrant.

The trial court is barred from revisiting its earlier suppression ruling under the doctrine of collateral estoppel, which holds that when an issue of ultimate fact has been determined by a final judgment, the issue can’t be re-litigated by the same parties, the U.S. Court of Appeals for the Tenth Circuit said Tuesday.
