X Corp.‘s request that Media Matters for America turn over in discovery its donors’ information and communications was improperly granted by a trial court, the Fifth Circuit said Sunday.
The ruling is the latest development stemming from X’s 2023 lawsuit accusing Media Matters of knowingly and maliciously driving away the social media giant’s advertisers by tying it to neo-Nazism.
The two discovery requests at issue are disproportional to the needs of the case, the US Court of Appeals for the Fifth Circuit per curiam opinion said, granting Media Matters’ motion to stay the district court order pending appeal.
