A woman whose father ran a predatory payday lending operation won’t be able to recover assets her father forfeited during a criminal case, the Third Circuit decided Wednesday.
To recover the forfeited property, Linda Hallinan needed to show that she was a good-faith purchaser for value or that her interest was superior to the government’s. Instead, Linda argued to the US Court of Appeals for the Third Circuit that no one used criminal funds to buy the assets.
